The preliminary hearing for a Wichita man facing five alternate counts of human trafficking in Reno County was delayed for a second time Tuesday - this time because the defense claimed the state did not follow proper procedures in filing the additional charges.

Human trafficking charges were added after the female victim, who did not speak English, testified in October through a translator that she lived in a trailer-like home she could not open or close. Steve Beranek was originally charged with abuse of a 1-year-old child, aggravated endangerment of a child and domestic battery. The complaint alleges the violations span from May 2011 to June 2013.

Beranek's defense attorney, Charles O'Hara, argued for the additional charges to be dismissed. He stated Beranek made his first appearance for human trafficking a day before the state completed filing all five counts. He also took issue with the state failing to provide affidavits of probable cause on the human trafficking.

Through much of the hearing, Beranek looked down, reading a magazine. Reno County Magistrate Judge Randall McEwen ruled that the state provide the affidavits by Dec. 12. He rescheduled Beranek's third preliminary hearing for Dec. 19, stating he didn't want to allow for the possibility that the matter come out later in the case.
